The terms "Alma Pure", "we", "us", and "our" refer to THEKEY LLC.
The website, its content, functions, products, tools, and services are hereinafter collectively referred to as "Services".
The online shop uses the technical infrastructure of Shopify.
These General Terms and Conditions govern the use of our services as well as orders placed through our online shop.
Orders are subject to the GTC version published at the time of contract conclusion.
Mandatory statutory consumer rights are not limited by these GTC.
2. Scope and Definition of Consumer
These GTC apply to contracts between THEKEY LLC and consumers concluded via the Alma Pure™ online shop.
A consumer is any natural person who concludes a legal transaction predominantly for purposes that can be attributed neither to their commercial nor their independent professional activity.
Deviating conditions of the customer are only valid if we have expressly agreed to their validity.
Individual agreements between us and the customer take precedence over these GTC.
3. Requirements for using the Shop
To place an order, you must be at least 18 years old or otherwise legally authorized to enter into the contract under applicable law.
You undertake to provide complete, accurate, and up-to-date information. This applies in particular to:

You are responsible for the accuracy of the information provided and for the consequences of incorrect, incomplete, or outdated information.

The website and our services may not be used for illegal, fraudulent, or unauthorized purposes.
4. Information about our Products
We strive to describe and display our products as accurately as possible.
Colors and surfaces may vary slightly from the actual representation depending on the screen, device, brightness, lighting, and individual display settings.
The appropriately marked Alma Pure copper products are manufactured in India by specialized craft businesses using traditional copper processing methods.
Due to the handmade production, minor differences may occur, especially regarding:

Shape;

Hammering;
-
Engraving;
-
Structure;
-
Dimensions;
-
Weight;
-
Surface finish.
Such minor artisanal deviations do not automatically constitute a material defect, provided that the product corresponds to the agreed quality, the product description, and the conventionally expected use.
Pure copper is a naturally reactive material. Through contact with air, water, and humidity, it can over time:

Darken;
-
Become duller;
-
Oxidize;
-
Develop superficial stains;
-
Form a natural patina.
Material-typical oxidation, patina formation, and color changes do not automatically constitute a material defect.
The information on the respective product page is decisive for the essential characteristics of a product.
5. Use and Care of Products
Products may only be used for the purpose intended in the respective product description and in compliance with the care and use instructions.
The customer is responsible for the proper use and care of the product.
Subject to mandatory legal rights, the following circumstances, in particular, are not considered product defects caused by us:

Damage due to impacts, drops, or accidents;

Damage due to improper or inappropriate use;

Damage caused by dishwashers if such cleaning was advised against;

Damage caused by abrasive cleaners, aggressive cleaning agents, or unsuitable chemicals;

Scratches or dents caused after delivery;

Normal wear and tear;

Changes due to insufficient or improper care;
-
Natural oxidation or patina formation;
-
Use contrary to product or care instructions;

Unauthorized repairs or alterations.
The customer's statutory rights in case of a defect already existing at the time of delivery remain unaffected.
6. Health and Wellness Information
Information on our website about copper, tradition, everyday life, or well-being is for general informational purposes only.
It does not constitute medical advice, diagnosis, treatment recommendation, or promise of healing.
Our products are not medicines and not medical devices, unless a product is explicitly marked otherwise.
They are not intended to diagnose, treat, cure, or prevent any disease.
The use of our products does not replace consultation or treatment by a doctor or other qualified healthcare provider.
In case of health complaints, known intolerances, or special medical needs, medical advice should be sought before use.
Individual experiences may vary. A specific health outcome is not guaranteed.
7. Product Availability
All orders are subject to product availability.
We reserve the right to:

Limit the quantity available per customer or order;

Temporarily suspend or discontinue the sale of a product;

Reject unusually high quantities that are not consistent with a typical private purchase;

Correct obvious errors in availability or stock levels.
Should an ordered product be unavailable after the order has been placed, we will inform the customer.
Amounts already paid for an unavailable product will be refunded, unless another product is expressly agreed upon.
8. Order and Contract Conclusion
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
The customer can place products in the shopping cart and review and correct their details before completing the order.
By clicking the final order button, the customer submits a binding offer to conclude a purchase contract.
After placing the order, the customer usually receives an automatic order confirmation. This initially only confirms receipt of the order, unless the email explicitly states that the order has already been accepted.
The contract is concluded as soon as we:

Expressly accept the order;

Transmit the shipping confirmation;

Or dispatch the goods,
whichever event occurs first.
We reserve the right to reject or cancel an order for a legitimate reason, especially in cases of:

If an order rejected by us has already been paid for, the corresponding amount will be refunded via the payment method originally used.
The contract is concluded in German.
9. Modification and Cancellation of an Order
Requests for changes or cancellations can be sent as quickly as possible to the following address:
We will try to make the requested change before the order has been processed, transmitted to the logistics center, or handed over to the shipping service provider.
A change or cancellation cannot be guaranteed if processing has already begun or the order has been shipped.
If the order has already been shipped, the customer can exercise their statutory right of withdrawal after delivery, in accordance with our return and refund policy.
The statutory right of withdrawal remains unaffected.
10. Prices
The prices displayed in the online shop at the time of the order apply.
Prices are shown in the currency specified in the checkout.
Where legally required, the displayed final prices include applicable taxes.
Delivery costs and any other additional costs will be displayed before the binding order is submitted.
We may change prices, discounts, and promotions at any time for future orders. Price changes do not affect contracts already concluded.
In the event of an obvious price error identifiable by the customer, we may:

Offer the customer the order at the correct price; or

Cancel the order and refund the amount already paid.
Discounts, promotional codes, and offers:

Are valid only for the specified period;

Cannot be redeemed for cash;

Are only combinable if explicitly stated;

11. Payments
Payment must be made using one of the payment methods offered at checkout.
The customer confirms to be authorized to use the selected payment method.
Payments can be processed via Shopify as well as via independent payment service providers.
We generally do not store full credit card or debit card data.
An order may be temporarily held, rejected, or canceled if:

Payment is rejected;

Authorization cannot be completed;

Conflicting information is found;

The transaction is deemed potentially fraudulent;

Additional legally permissible checks are necessary.
For fraud prevention purposes, we may request information reasonably necessary to verify the customer's identity or authorization to use the payment method.
12. Retention of Title
The delivered goods remain the property of THEKEY LLC until full payment of the purchase price.
13. Manufacturing and International Logistics
The appropriately marked Alma Pure copper products are handcrafted in India.
After production, the products may be forwarded to our international logistics center in Shenzhen, China. There, they can be inspected, sorted, assigned to an order, and prepared for international shipping.
The shipping or transit country displayed in the tracking may therefore correspond to the location of a logistics center or a transshipment point.
It is not necessarily the country of manufacture of the product.
The indication of China, Hong Kong, or another transit country in the tracking does not change the fact that our appropriately marked copper products are manufactured in India.
14. Shipping and Delivery
The processing and delivery times indicated on the website or on the respective product page are estimated periods.
Unless otherwise stated on the product page, the estimated total delivery time is generally 5 to 21 business days.
Business days are Monday to Friday, excluding public holidays.
Due to handmade production, high demand, or international logistics, longer processing times may occur.
Delays may be caused in particular by:

Artisanal production;

Exceptionally high order volumes;

Customs controls;
-
Delays by the shipping service provider;

Public holidays;
-
Extreme weather conditions;

Strikes;

Transport disruptions;

The customer's mandatory statutory rights in case of delivery delays remain unaffected.
The customer must provide a complete, correct, and accessible delivery address for the shipping service provider.
We are not liable for additional costs or delays caused by the customer, in particular due to:

An incorrect or incomplete address;

A missing name on the doorbell or mailbox;

An incorrect phone number;
-
Lack of cooperation in delivery;
-
An uncollected shipment in time;
-
An unjustified refusal of acceptance.
If a package is returned for a reason attributable to the customer, the actually incurred and reasonable costs of a new delivery may be charged.
15. Transfer of Risk
For consumers, the risk of accidental loss or accidental damage generally passes to the customer only when the customer or a third party designated by them, who is not the carrier, has received the goods.
If the customer commissions a shipping service provider themselves, which was not offered by us, deviating legal rules may apply.
After handover, the customer is responsible for the proper storage and use of the product.
16. Tracking and Packages Marked as Delivered
If the tracking shows a delivery, but the customer states that they have not received the shipment, they must contact us as soon as possible.
To investigate the delivery process, we may specifically ask for the following information:

Confirmation of the delivery address;

Written statement of non-receipt;

Check with household members, neighbors, property management, or parcel shop;

Information about possible drop-off locations;

Documents required by the shipping service provider;

The opening of an investigation does not automatically lead to a refund or replacement.
The solution depends on the outcome of the investigation and the customer's legal rights.
The "delivered" status is an important indication of delivery, but it does not constitute irrefutable proof.
17. Right of Withdrawal, Returns and Refunds
Consumers generally have a statutory right of withdrawal.

Returns & Refunds
In the event of a simple change of mind, the customer bears the direct costs of returning the item. This may include international shipping costs to the logistics center communicated by customer service.
Please contact our customer service before any return so that the appropriate return address can be provided.
Products should not be:

returned without prior notification;

to an uncommunicated address;
-
to our business address in the United States;
-
or to the sender address indicated on the received package.
This provision does not limit the statutory right of withdrawal or the rights regarding defective or incorrectly delivered products.
18. Statutory Warranty Rights
Consumers have statutory warranty rights.
We are liable according to statutory provisions for material defects existing at the time of delivery of the goods.

We can only refuse the chosen type of subsequent performance under the statutory conditions.
If subsequent performance fails, is refused, or is not legally required or unreasonable, the customer may have further rights, in particular:

If a return is necessary for subsequent performance, THEKEY LLC bears the legally required costs.
19. Additional Commercial Guarantees
An additional commercial guarantee only applies if it is expressly offered on the respective product page.
A commercial guarantee applies in addition to and does not restrict the statutory warranty rights.
The conditions, terms, services, and exclusions published on the product page or in separate guarantee conditions apply to a commercial guarantee.
If a limited lifetime warranty is expressly offered, "lifetime" refers to the normally expected lifespan of the product in question under normal private use by the original buyer, and not the buyer's lifetime.
Unless otherwise stated in the guarantee conditions, a commercial guarantee exclusively covers proven material or manufacturing defects under normal and proper private use.
It particularly does not cover:

commercial or unusually intensive use, unless the product is intended for this purpose.
Obviously abusive, manipulated, or fraudulent warranty claims may be rejected.
20. Intellectual Property
The content of the website, including:

Our online store uses Shopify as its technical platform.
Purchase contracts for Alma-Pure products are concluded between the customer and THEKEY LLC.
Shopify is not the seller of the products and is generally not responsible for:

product quality.
The use of Shopify may involve the processing of personal data in accordance with our privacy policy and Shopify's privacy information.
25. Correction of Errors

In the event of slightly negligent breach of a material contractual obligation, liability is limited to the damage typical for the contract and foreseeable at the time of contract conclusion.
Material contractual obligations are obligations whose fulfillment enables the proper execution of the contract and on whose observance the customer can regularly rely.
Otherwise, liability for damages caused by slight negligence is excluded, to the extent permitted by law.
THEKEY LLC is particularly not liable for damages caused by:

insufficient or improper care;

incorrect or incomplete information provided by the customer;

28. Payment Disputes and Chargebacks
The customer can contact our customer service at any time with problems related to an order.
This recommendation does not limit the customer's right to dispute an actually unauthorized charge with their bank, card provider, or payment service provider.
In the event of a chargeback, PayPal case, or other payment dispute, we may transmit the information and evidence required for verification to the respective payment service provider.
This may include, in particular:

31. Consumer Dispute Resolution
We strive to resolve complaints and disagreements directly and amicably.

THEKEY LLC is currently neither obliged nor willing to participate in dispute resolution proceedings before a German consumer arbitration board, unless there is a compelling legal obligation.
32. Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
This choice of law does not result in a consumer being deprived of the protection afforded to them by mandatory provisions of the state of their habitual residence.
For consumers, the statutory rules of jurisdiction apply.
An exclusive place of jurisdiction at the registered office of THEKEY LLC is not agreed upon with consumers.
33. Amendments to these GTC
We may amend these GTC for future orders, particularly due to legal, technical, operational, or business developments.
For an order, the version published at the time the contract was concluded applies.
Amendments do not apply retrospectively to already concluded orders, unless required by law or expressly agreed upon with the customer.
34. Severability Clause
Should a provision of these GTC be wholly or partially invalid, unlawful, or unenforceable, the remaining provisions shall remain valid.
Applicable statutory provisions shall replace an invalid provision.
35. No Waiver of Rights
The delayed or omitted exercise of a right does not constitute a waiver of that right.
A waiver is only valid for the specific case to which it expressly refers.
